The Truth: Crypto is NOT illegal in India. But 90% people invest in the WRONG way and get into tax trouble.
If you want to invest safely without any notice from Income Tax or FIU, follow this 7-step LEGAL framework.
Read till the end, Step 6 is most important.
STEP 1: CHOOSE ONLY FIU-IND REGISTERED EXCHANGE
This is non-negotiable in 2026.
Any exchange operating in India MUST be registered with FIU-India under the PMLA Act.
If an exchange is not on the FIU list, your money is not safe and not legal.
What to check before signing up?
- FIU-IND Registration Number on their website
- Proper Company Entity in India
- KYC with PAN verification
- Shows 1% TDS deduction transparently
List can be verified on: fiuindia.gov.in
STEP 2: NEVER USE CASH OR 3RD PARTY P2P
The biggest mistake that attracts IT Department notices.
To stay 100% legal:
- Invest ONLY from your own linked bank account (same PAN)
- Never take help of friends/family account
- Avoid random Telegram P2P sellers promising "No TDS"
- Avoid cash deals - they are treated as black money under PMLA
Your bank statement is your proof of legality.
STEP 3: UNDERSTAND THE TAX RULES BEFORE YOU INVEST
In India, crypto is taxed as Virtual Digital Asset (VDA) under Section 115BBH.
1. 30% Flat Tax on PROFIT. Not on total amount. No slab benefit.
2. 1% TDS under 194S on every SELL transaction. Your exchange deducts it automatically.
3. NO Deductions: You cannot deduct fees, internet bill, etc. Only Cost of Acquisition allowed.
4. NO Loss Adjustment: If you lost ₹20k in one coin and gained ₹20k in another, you still have to pay tax on the ₹20k gain. Loss cannot be set off.
Pro Tip: The 1% TDS you paid is adjustable against your total tax. Download Form 26AS.
STEP 4: MAINTAIN PROPER DOCUMENTATION
Your CA will need this during ITR filing. Don't wait till March.
Every month, download:
- Complete Trade History (CSV)
- P&L Report
- TDS Certificate / 26AS
- Bank Statement showing deposits to exchange
Create a separate folder: "Crypto Investments FY 2025-26"
This 10-minute habit will save you from lakhs in penalties.
STEP 5: SECURE YOUR INVESTMENT LIKE A BANK
Legally safe is not enough, technically safe bhi hona chahiye.
- Enable 2FA (Google Authenticator, not SMS)
- Never share your seed phrase with anyone
- For long-term holding, use a hardware wallet (Ledger / Trezor)
- Use whitelisting for withdrawal addresses
- Beware of fake apps, phishing links promising double returns
Remember: In crypto, you are your own bank.
STEP 6: HOW TO REPORT IN ITR - THE LEGAL WAY
This is where most people fail.
You MUST report crypto under the new VDA Schedule in ITR-2 or ITR-3.
- Report date-wise purchase and sale
- Do NOT hide it under "Other Income"
- Disclose even if you have not sold - if you hold, show balance
- Pay Advance Tax if your profit is high
Non-disclosure can lead to 100% penalty and scrutiny under Section 158B.
STEP 7: FOLLOW THE GOLDEN RULES OF INVESTING
1. Invest only 2-5% of your portfolio in crypto. It's high-risk.
2. Don't take loans to invest in crypto.
3. Don't fall for "Guaranteed 1% Daily Return" schemes. They are illegal Ponzi.
4. Think long-term (3-5 years), not overnight rich.
FINAL WORD:
Government of India is not against crypto, it is against ILLEGAL use of crypto.
If you follow FIU + PMLA + Income Tax rules, you can invest in crypto with 100% peace of mind.
Crypto is legal. Tax evasion is not.
